Welcome to the website of the Warriors Remembrance Foundation, Inc., doing business as the Warriors Remembrance & Research Foundation ("WRRF," "we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our website, online databases, volunteer portals, donation platforms, social media pages, and all related services, content, and resources (collectively, the "Site").
By accessing, browsing, donating through, submitting information to, uploading content to, volunteering through, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should discontinue use of the Site immediately.
1. Purpose of the Site
The Warriors Remembrance & Research Foundation is a nonprofit charitable organization dedicated to honoring veterans through cemetery preservation, historical research, memorialization, education, advocacy, and community engagement. The Site serves as a free public resource designed to preserve and share information regarding veterans, cemeteries, military history, genealogy, memorialization efforts, volunteer opportunities, educational programs, and charitable activities.
To use the Site, you must be at least eighteen (18) years of age, or at least thirteen (13) years of age with the consent of a parent or legal guardian. By using the Site, you represent that you have the legal authority to enter into these Terms and that your use complies with all applicable laws and regulations.
WRRF reserves the right to modify these Terms at any time. Changes become effective immediately upon posting. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
2. Intellectual Property, Research Collections, and Free Public Access
WRRF is committed to providing free public access to veteran, cemetery, genealogical, historical, and memorial information in furtherance of its educational and charitable mission. The information contained on the Site is intended to serve veterans, families, researchers, educators, historians, genealogists, students, and the public at no cost.
Unless otherwise noted, all Site content, including but not limited to veteran biographies, historical narratives, cemetery inventories, research findings, memorial pages, databases, photographs, graphics, videos, publications, educational materials, logos, software, website design, metadata, and search functionality (collectively, "Site Content"), is owned by WRRF, licensed to WRRF, or used with permission and is protected under applicable intellectual property laws.
While many records incorporated into WRRF's research may originate from public records, military records, government documents, newspapers, family submissions, archives, and other publicly available sources, WRRF retains all rights available under law relating to the selection, compilation, organization, indexing, enhancement, interpretation, presentation, and arrangement of such information.
Visitors may use Site Content for personal, educational, historical, genealogical, nonprofit, classroom, and memorial purposes. However, users may not reproduce substantial portions of the Site, scrape or harvest data, create derivative databases, mirror memorial pages, incorporate WRRF research into commercial or subscription-based services, or otherwise exploit WRRF's research collections, databases, photographs, or content without prior written permission.
The fact that WRRF makes information freely available does not constitute a waiver of its intellectual property rights or permit commercial reuse of its research collections. WRRF expressly prohibits the transfer, republication, or commercialization of its databases, veteran profiles, cemetery inventories, photographs, and research compilations by third parties. Nothing contained herein shall limit rights otherwise available under applicable fair use laws.
3. User Submissions and License Granted to WRRF
WRRF welcomes the submission of photographs, military records, biographies, oral histories, cemetery records, genealogical information, videos, audio recordings, and other materials that help preserve and honor the legacy of veterans.
By submitting content to WRRF through the Site, email, social media, online forms, mail, or any other method, you represent and warrant that you own or control the rights necessary to submit such materials and that your submission does not violate the rights of any third party.
You further grant WRRF, its affiliates, successors, partners, contractors, sponsors, volunteers, and licensees a perpetual, worldwide, royalty-free, irrevocable, transferable, and sublicensable license to use, reproduce, preserve, digitize, archive, modify, publish, distribute, display, adapt, translate, create derivative works from, and otherwise utilize submitted materials in any medium now known or later developed.
This license includes use for historical research, genealogy, educational programming, memorialization, fundraising, marketing, publications, social media, presentations, exhibits, merchandise, licensing opportunities, and other activities supporting WRRF's charitable mission. No royalties, fees, compensation, or future payments shall be owed for such use.
4. Archival Preservation and Publicity Rights
Because preservation of veteran history is central to WRRF's mission, submitted materials may be archived indefinitely and incorporated into historical collections, databases, publications, memorial projects, and educational resources. WRRF reserves the right to maintain backup copies and transfer archival collections to successor organizations, museums, libraries, educational institutions, historical societies, or government repositories.
By submitting materials, volunteering, attending events, participating in programs, or otherwise engaging with WRRF, you consent to the use of your name, likeness, image, voice, military history, biographical information, and testimonials for educational, historical, memorial, fundraising, marketing, promotional, and archival purposes without compensation.
You further acknowledge that submitted materials may be processed, indexed, cataloged, transcribed, summarized, analyzed, digitized, enhanced, or otherwise utilized through database technologies, artificial intelligence tools, machine learning systems, archival software, and future technologies developed after submission.
5. Donations and Restricted Funds
All donations made to WRRF are voluntary and non-refundable. WRRF retains exclusive legal control and discretion over all donated funds consistent with applicable law and donor intent.
Donors may designate contributions for specific cemeteries, programs, or projects. Such designations will be honored whenever practicable and lawful. However, all donated funds remain the property of WRRF. Should a designated purpose become impossible, impractical, unlawful, obsolete, or inconsistent with WRRF's mission, WRRF reserves the right to redirect such funds to a substantially similar charitable purpose.
No donation creates a trust relationship, agency relationship, fiduciary relationship, partnership, ownership interest, or contractual right in favor of any donor.
6. Disclaimers, Limitation of Liability, and General Provisions
The Site and all information contained therein are provided on an "as is" and "as available" basis. WRRF makes no warranties, express or implied, regarding the accuracy, completeness, reliability, availability, or suitability of Site Content. Historical, military, genealogical, and cemetery research often relies on public records, archives, family submissions, newspapers, oral histories, and other sources that may contain inaccuracies, omissions, or conflicting information. Users are encouraged to independently verify all information before relying upon it.
Nothing contained on the Site constitutes legal, tax, financial, estate planning, benefits, genealogical certification, or other professional advice. Users should consult qualified professionals regarding their individual circumstances.
To the fullest extent permitted by law, WRRF and its officers, directors, volunteers, employees, contractors, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of, or inability to use, the Site or any information contained therein.
You agree to indemnify and hold harmless WRRF from any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from your use of the Site, your violation of these Terms, or materials submitted by you.
These Terms shall be governed by the laws of the State of Texas. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Comal County, Texas. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
